The MVC Ont. Regulation 153/06 does not apply to the operation of a structure and therefore does not regulate water flows. Operation of the Enerdu facility is subject to the Mississippi River Water Management Plan which was mandated and is enforced by the Ministry of Natural Resources under the Lakes and Rivers Improvement Act. MVC is a proponent of the Plan by virtue of the water control structures which are owned by MVC and its watershed jurisdiction.
Reference to 118 cubic meters per second is inaccurate. The upper compliance level for the Enerdu G.S. is 118.0 m. We are just confirming that the normal upper operating level for the new facility will continue to be 117.7 m as indicated in the Environmental Assessment Report.
